Terms of Service

By accessing or using the GCEA platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

GCEA is a gamified digital platform centered around Pokémon card collecting. Users can earn virtual "candies" through daily activities, participate in raffles for physical prizes, join factions, and engage with community features. The $ASH token and any staking mechanics are simulated and do not represent real cryptocurrency or financial instruments unless explicitly stated otherwise.

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 13 years of age to use the Service. One account per person — creating multiple accounts to abuse referral or reward systems is prohibited.

You agree not to:

• Use bots, scripts, or automated tools to interact with the Service
• Exploit bugs or glitches for unfair advantage
• Harass, abuse, or harm other users
• Attempt to manipulate leaderboards, raffles, or reward systems
• Share, sell, or transfer your account
• Use the Service for any illegal purpose
• Circumvent security measures, rate limits, or access controls
• Scrape, mine, or collect data from the Service without authorization

Candies (Regular, Silver, Golden), Shards, and Spin Tickets are virtual items with no real-world monetary value. They cannot be exchanged for cash and exist solely within the GCEA ecosystem. We reserve the right to adjust earning rates, costs, exchange rates, and balances at any time without notice.

Physical prizes (such as graded Pokémon cards) are awarded through raffle drawings. Winners are selected randomly. Prizes are shipped to the address provided by the winner within the United States. International shipping may not be available. We are not responsible for prizes lost or damaged in transit. Prize availability and raffle terms may change without notice. No purchase necessary to enter where prohibited by law.

Card pricing, market values, rarity scores, grading estimates, and collectibility analysis displayed on the Service (including Rarity Reports) are provided for informational and entertainment purposes only. GCEA does not provide financial, investment, or professional appraisal advice. Pricing data is sourced from third-party providers (including TCGPlayer, PokePriceTracker, and the Pokémon TCG API) and may be inaccurate, incomplete, or outdated. GCEA is not responsible for errors in third-party pricing data. You should not rely solely on GCEA pricing data when making buying, selling, or grading decisions.

Certain features of the Service, including card identification (scanning), card analysis, and chat functionality, are powered by third-party artificial intelligence services. AI-generated content may be inaccurate. GCEA does not guarantee the accuracy of AI-powered identification, analysis, or recommendations.

Partner stores are independent businesses. GCEA is not responsible for the products, services, or conduct of partner stores. QR check-in rewards are subject to change.

All original content, designs, branding, and code on the GCEA platform are owned by GCEA Capital. "GCEA," "Rarity Report," and the GCEA logo are trademarks of GCEA Capital. Pokémon is a trademark of Nintendo / The Pokémon Company. GCEA is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, or any related entities. Card images are provided by the Pokémon TCG API.

You agree to indemnify, defend, and hold harmless GCEA Capital, its operators, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your account at any time for violations of these terms or for any reason at our discretion, without prior notice. Upon termination, your right to use the Service ceases immediately. Virtual items, candies, shards, and other in-platform balances are forfeited upon termination. You may request deletion of your account by contacting support.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uptime, accuracy, availability, or uninterrupted access. Use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GCEA CAPITAL AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts located in Texas. You agree to submit to the personal jurisdiction of such courts.

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email or in-app notification. It is your responsibility to review the Terms periodically.
